Terms of Service

1. Acceptance
By creating an account on Attendari, you (the "Customer") agree to these Terms. If you do not agree, do not use the service.
2. The service
Attendari provides an AI-powered receptionist that operates on the Customer's WhatsApp Business, with scheduling, deposit collection, reminders, and a management dashboard.
3. Account
- The Customer must have legal capacity to contract (18+ or a valid business entity)
- Information provided must be truthful and current
- The Customer is responsible for credential security
- Account activity is the account holder's responsibility
4. Acceptable use
The Customer may NOT use Attendari to:
- Spam or bulk unsolicited messages
- Illegal, abusive, discriminatory, or deceptive content
- Violate the privacy or rights of third parties
- Bypass Meta's (WhatsApp Business Policy) or partners' rules
- Reverse-engineer, scrape, or abuse the API
Violation results in immediate suspension without refund.
5. Plans and payment
- Plans: Solo, Pro, Business (see pricing page)
- 14-day free trial (no card required at sign-up)
- Recurring billing via Stripe
- Automatic monthly/annual renewal; cancel anytime
- Prorated refunds are not offered for mid-cycle cancellations
- Late payment: service suspended after 7 days; canceled after 30 days
6. Third-party costs
Attendari passes through, with no markup, costs charged by:
- Meta WhatsApp: customer-initiated messages are free (up to 1000/mo). Business-initiated messages (reminders, follow-ups) follow Meta's pricing
- Payment processors: standard processing fees on deposit transactions
7. Liability
Attendari is not liable for:
- Downtime of third-party services (Meta, Stripe, payment processors, Cloudflare)
- Business decisions made based on AI responses
- AI-generated content that, despite controls, may be interpreted as inadequate by the end customer
- Lost profits or indirect damages
Our total liability is capped at the amount paid by the Customer in the last 3 months.
8. SLA
- Target availability: 99.5% monthly
- AI response time: < 5s under normal conditions
- Support: business days, 9am-6pm (BRT), via WhatsApp or email
9. Intellectual property
Attendari's software, brand, and visual identity belong to Oligon Technology (CNPJ 65.292.100/0001-84). The Customer retains all rights to their own content (customer lists, configurations, conversations).
10. Privacy and LGPD/GDPR
Personal-data processing follows our Privacy Policy. Regarding end-customer data, Attendari acts as Processor (LGPD Art. 5 / GDPR Art. 4) and the Customer as Controller. A DPA template is available on request.
11. Suspension and termination
Attendari may suspend or terminate the account for:
- Violation of these Terms
- Non-payment for 30 days
- Legal order
Customer-initiated termination: anytime via app Settings. Data is available for export for 30 days after cancellation.
12. Governing law and forum
These Terms are governed by Brazilian law. The forum of Sรฃo Paulo, SP is elected to settle disputes.
13. Changes
Material changes will be communicated 30 days in advance by email. Continued use after that period means acceptance.
